The hearing is well before the scheduled execution, and it sounds likely that the hearing will vacate the conviction, from what I read. The court is just saying that there's an established process for this and the lawyers just need to follow that process. ETA: Not to say that our legal system isn't horribly broken, because it is. During the pandemic. When the vaccine started rolling out it should have gone to population centers and first responders. It went to Timbuktu. Because the population centers were blue. Vulnerable people and first responders had to make cross state treks trying to get the vaccine. The cities and urban areas were some of the last areas to get it.
