I'm not a lawyer, but I think if the courts find him guilty, the courts decide the fine and jail time. But if the medical board finds HIPPA violations, they decide what happens to his medical license. He can potentially beat the court charges because many courts have been stacked to be hard-line/alt right wing from Trump's appointment of judges.
